Q: Can parents sue children for not taking care of them
As all children have equal responsibility to take care of parents financially, physically and emotionally, is it possible to have a legal agreement regarding the same. If any of the child does not look after parents physicallt, is it possible to sue the child who has not taken care and get compensation
Advocate Pallavi Rabinathan Dugar answered
Yes, where there are siblings there could be an arrangement of sorts between them and their parents to shoulder the financial and other responsibilities of the parents. The law has also provided for right of parents to be maintained by their sons under section 125 of the CrPC.
Q: How to file a consumer case in the court
Hi, A financial institution has cheated me by using my PAN card and issuing a loan to someone without my knowledge and consent. I got to know this when i tried applying for a loan with a bank and they rejected saying I have an overdue on my CIBIL. I called up their customer care and confirmed the details in which only my PAN details are matching. I want to lodge a fraud case with consumer court and a drfamation case for damaging my respect. Could you please help me how to get this done. Thanks a billion.
Advocate Pallavi Rabinathan Dugar answered
You should send a legal notice through an advocate to the financial institution outlining the fraud that they have committed. If they do not respond within a fortnight's time to your legal notice you should forthwith file a consumer complaint at the District consumer forum of your state. The Consumer courts are very efficient and you will have redressal of your grievance and compensation for the damages suffered by you very promptly.
Q: How to file for divorce when husband not supporting financially
I don't have any financial support . I am feeling depressed . My husband doesn't likes me . As we are fighting all these days. He has extramarital affairs. What to do regarding the kid. I have 1 year 6 months kid. It's been 4 years.
Advocate Pallavi Rabinathan Dugar answered
I understand the gravity or your situation. Please do not lose heart as there are effective laws to protect your interests. I would suggest you promptly file a DV case for cruelty, emotional harassment and abuse as he is engaged in extra marital affairs. Simultaneously file interim applications for maintenance. You are entitled to seek as much financial maintenance as you are spending towards yourself and your child- this includes money spent towards rent, house upkeep, food and clothing and other necessary expenditure. Once this is filed and the Court passes a favourable interim order your issues will be taken care of to a large extent and then you may decide whether you want to divorce him or not. I hope this was helpful. Please fight your depression and stay positive and strong!
Q: Consumer complaint for wrong product purchased online
I have purchased TV and hardware is different from specifications on website. Should I go consumer forum and how much compensation I can claim?
Advocate Pallavi Rabinathan Dugar answered
First ensure that you paid for the TV with same specifications as shown on Website. If your bill reflects to the contrary you will not be able to initiate action. The principle being you get what YOU actually paid for and not what you thought you paid for. If the store from which you purchased, erroneously gave you the wrong product then you may first send them a notice stating the same. In the event that they refuse to acknowledge your notice or rectify it you may proceed with filing a case at the consumer forum.
Q: is Second Wife Entitled For Maintenance
Hi, does second wife has rights for maintenance whereas 1st wife is already getting maintenance as per the court orders, now we want to file biagamy case against them as 1st wife is still not devorced, our worry is if we file biagamy will the 2nd wife Wil get share from the awarded maintenance money??
Advocate Pallavi Rabinathan Dugar answered
If the first marriage was not dissolved and was in existence at the time of the second marriage then second marriage is invalid in law. In keeping with this, the question of maintenance for second wife will not arise. However recent case laws have provided for maintenance of women who have been in live -in relationships. But this case scenario is different. The best plan of action would be to sue for bigamy and claim compensation.
