Q: Discharge from IAF on Psychiatric Illness Ground

I enrolled in IAF in 2009. I was diagnosed depression in Aug 2023. Last medical board held in Dec 2025 and placed in A4G4(P). I applied for discharge from service on medical grounds and it was not approved by AFRO. Please suggest legal advice to get discharge from IAF on medical ground or any other ground.

Your case is governed by the Air Force Act, 1950, Air Force Rules, 1969 and the Armed Forces Tribunal Act, 2007. Since you have been placed in A4G4 (Permanent Low Medical Category) due to depression and your request for discharge was rejected by AFRO, you may first file a Statutory Complaint under Section 26 of the Air Force Act challenging the rejection on grounds of arbitrariness, non-application of mind, and incompatibility of permanent psychiatric low medical category with active service. Simultaneously, you may seek a Review Medical Board with specialist psychiatric evaluation to reassess fitness and recommend invaliding out if appropriate. If you have completed the qualifying service, you may also apply for voluntary/premature discharge under the applicable service regulations.If administrative remedies fail, you may file an Original Application before the Armed Forces Tribunal (AFT) under Section 14 of the AFT Act seeking quashing of the rejection order, direction for medical discharge, fresh medical board, and consequential pensionary benefits. If invalided out, you may claim disability pension (subject to proving the condition is attributable to or aggravated by service). It is important to maintain continuous medical records and avoid any disciplinary misconduct, as improper exit can affect pension rights.
