Questions Answered by Advocate Natasha
Q: R&R plots-legal heirs not cooperatingg
We are 3 sons of our mother who died a very long time back. Now there is one plot issued by government under R&R to our mother. Out of three, one son is not cooperating and neither giving his portion to us neither claiming to government. How can this entire plot transfer to me where one brother is ready to give his consent but 2nd brother is not responding.
Advocate Natasha answered
The entire plot cannot be transferred to your name merely on the consent of one brother. The consenting brother can execute a registered relinquishment deed for his share. For the non-cooperating brother, a legal notice may be issued and if he still does not respond you may approach the civil court for appropriate relief
Q: Delay by developer to hand over
I had booked a commercial property with a developer in Gurgaon in 2010. Expected completion was to be in 2-5 years. Last year I was informed it would be Dec25, this year I am being informed that it will be Dec26.i would like to know what are my rights against the developer for such delay in hand over.
Advocate Natasha answered
Based on the facts shared, you appear to have legal remedies against the developer for the prolonged delay in handing over possession. If your project is registered under RERA you may file a complaint before the Haryana RERA seeking delay compensation, interest for the delayed period or even refund with applicable interest depending on your preference and the terms of your Builder Buyer Agreement. If the project is not covered under RERA or the cause of action arose earlier other remedies such as a consumer complaint or civil proceedings may also be available, subject to the facts and limitation.
