Q: Non payment of maintenance even after getting an order from court

Hi, this matter is related to The Maintenance and welfare of Senior Citizens and Parents Act 2007. The plaintiff filed an appeal in the court of SDM cum Tribunal for senior citizens. and SDM passed an order of maintenance in 2011, that respondent has to pay 1000 monthly to plaintiff. But respondent never paid a single amount till today. The plaintiff is senior citizen and she didn't appeal about non-payment of maintenance. But later she filed appeal again in SDM Court on May 2018. But SDM didn't pass any order yet. So I just want to know that Could she go to high court or seek directions from high court for action???

No she can not move directly high courtIf SDM did not pass any order then she can move to DC .She can file an application of execution for recovery of maintenance.If DC also will not consider then she can move to HC



Q: Can a girl do court marriage without any age proof that she is 18

I am in a relationship since 2 years and my age is 19 years and i am a Hindu and she is 18 years old and she is Muslim but she don't have any age proof to show to the court to get decision in her favour and now her parents are doing there forced marraige without her consent and she wants to marry me and I also bit in this critical situation no one is helping me her marriage was on 6 September and I also discussed my case with a lawyer but he said that your gf don't have any age proof so in that case I can't help you so now what I can do plzz reply me fast days are very short few days are left for her marraige that I have given the date plzz give a solution

First of all where r u residing.And if u hv no id proof u can file an affidavit before the court by stating that all d documents r in possession of the parents of the girl.Further u can get protection from the high court



Q: Remedies against frivolous complaints

I have been harassed by being a subject of series of multiple false police complaints by a person since last 4-5 years in the same matter. Although all the complaints were filed and his complaints were found by police as of civil nature as the complainant has never presented any actual proof or evidence and has propagated his false complaintsby local political pressure. Although a FIR was never registered but i had to present myself in police stations several times and undergo unnecessary harassment at different times. the complaint was filled by police at least 8-9 times including a SIT investigation and a inquiry by IG Police. He has alleged, that i used details of his firm to manufacture a product under his name which is not true, there is only speculative theory to support his argument and he uses this plea to call for sec 420. Is there a way the police can be forced by court to open sec 182 for him or sec 156(3) ? is there any legal means i can fight him?

Move an application to the concerned police official to register a case against him under section 182 ipc and u can also file a case for defamation and u can also file a complaint before court under section 500 of ipc



Q: How to recover my pending amount from RCOM

Sir, i am distributed of RCOM last 11 year. He closed his service suddenly date 27/10/2018. Appox 85 lacs is pending amount including demo balance , schme, billing amount.pl give advice how we recover our amount.

U may file a recovery suit before the competent court of law.If the company is inGovt then u must issued a notice under section 80 of CPC of 60 days.If they failed to make d payment under that period u can file the recovry case



Q: how long it would take to bail a person under 420 & 120

hi everyone.... nd my relative is in jail for three yrs. under section 420&120 by the order of session court rewari dated 11/05/18. i want to challenge this in high court chandigarh so can anyone tell me how much time it would take to bail him nd what would be the actual proceeding of court,nd plz also let me know whether court is gonna listen us in June vacations or not

As per Ur case Ur relative has been firstly convicted by trial court then Ur relative file an appeal before session judge and he upheld d sentence awarded by trial court.Now u will be file revision against d order if session judge.Ur case Can be heard during vocation but about 6 month court will not grant bsil to him .Minimum period is 6 month.Mohit singla advocate High court Chandigarh
