Q: What to do SBI after few months decline my loan request

Hi, SBI bank approved my house for lease and provide a letter for house modification as per bank requirement. We have modified our home as per provided letter by bank and spend money approx 2 lac for house modification. After few month now bank denied to come on lease. Request you pls suggest what to do. We spend 2 lac rupees for house modification as per provided letter by bank.

If you have any kind of agreement or MOU then it will depend upon the terms and conditions of that documents. For now you can either file a suit for recovery of damages and initially send them a legal notice. After perusal of the document it can be seen what other rights you have before the court of law.



Q: Legal action in case sale deed giving exclusive right of parking

I have a bungalow and sold my second floor but the sale deed clearly mentioned that “the vendor will have exclusive right of parking in driveway”. Now my neighbours demand parking. Is it possible to proceed with the case on the basis of sale deed.

Either way you have a strong case. If you file you can restraint them for parking in your drive way and if they file, they won't get any relief primarily. And you are not liable to provide them with parking if its not mentioned in the sale deed.



Q: Uncle has stolen property of grandfather without letting us know

Hi.. We are Sikh by religion. My grandparents has 2 sons. 1 died i.e. my father and my uncle is alive. we had a Ancestor property in Bhogal South Delhi. In 2012 or 2013 my uncle had sold the property without our consent. Can I file 420 case against him as we are 5 siblings and we have a equal right.

Yupp 420 is completely made out. And we can file a civil case also for declaration. We can start with filing a criminal complaint and with a civil suit. Can attack the other party with multiple litigation as whatever he has done is cheating per se.



Q: How to proceed for challenge or cancellation of relinquishment deed

I wish to state that I am living in West Delhi, on 15/10/2015, we (myself & my sister) have made the RELINQUISHMNET DEED in favour of my MOTHER, but after the few month, my mother turned to against my family and disinherit us on june 2016 and after on march 2017 filled a suit for immediate vacate from house. May I challenge / cancellation of relinquishment deed which I have made in favour of my mother on oct-2015, my sister who also legal hires made RD with me in favour of mother , but now she is supporting my mother.

First we have to see whether the relinquishment deed is registered or not. If the same is just notarized then it doesn't carry any value. Any which way a suit for declaration can be filed against your mother and sister for cancellation of the aforesaid deed on various grounds which can be ascertained later. But filing of a suit is necessary otherwise you have no other right.

File a fresh RTI asking whether the construction is authorised or not. Wait for the reply. And on the basis of the reply a writ can be filed against the unauthorized construction. But you should not be having any unauthorized construction on your part also.
