I was having extra marital relationship with a married man. My husband found out and has proof of adultery. He wants to file divorce and is not agreeing to pay anamoly. I want to file a case against the person with whom I had an affair and also demand maintenance from him. Pls advice what case can I file against the Person and also advice how can I get anamoly from my husband? Can my husband also file a law suit against the person with whom I had affair?

it all depends on what kind of proof your husband has with him it is difficult to prove adultery in court of law a right of alimony cannot be taken away. it will not be useful to file case against that person as of now your husband can make him party in divorce proceedings

Advocate Manoj Parve answered
If your Marriage is registered under Special Marriage Act, then annulment is a good option for you. Otherwise you can file contesting Divorce case even before completion of one year to your marriage specifying special circumstances. In family matters, it is always better to try to sort it out mutually and reach on conclusion either living together peacefully or getting seperated peacefully that is by way of mutual consent Divorce.

Q: File a divoce as she is not wanted to live with me

She is not adjusting with me as she extremely short tempered and suffering from mental illness. We have two children of age 12yrs and 15 yrs. She is also want to divorce.

Advocate Manoj Parve answered
You can go for mutual consent Divorce with mutually agreed terms, if she is ready for it. Or else, you can file contesting Divorce case against her, which can afterwards be converted into mutual consent Divorce case.

Q: Wifes rights in case of Mutual consent or contested divorce

I have a question regarding Wife's rights in case of divorce as my cousin is going through a failed marriage.Husband is a salaried with gross income of 1 lakh per month and wife is a dentist but not doing a job or practice currently. She owns an apartment jointly with her mother. Also her parents are quite rich and having multiple properties.Whereas Husband owns an apartment jointly with his mother and there is home loan pending for same. Both are aged 35 and having 8 year old child.then in case of divorce:1. Still Husband will need to pay monthly maintenance OR one time alimony ? and how much max in this scenario?2. will wife have a claim in Husbands jointly owned apartment and also inherited land if any?

Advocate Manoj Parve answered
