Q: Legal suggestion on case 138 NIA please suggest mi what should i do.

On cheque bounce of 427000/-, i have a case of 138 NIA ,i have received the date of hiaring i.e 20/10/2018, so i want suggetion that what will be happend on that hiaring

Who are you ? I hope you are accused !, after receiving a notice/summon of appearance, you need to tell the Magistrate whether you had defaulted in payment of said cheque and you accepted the offence or you have not defaulted and you want a further proceedings or trial in this case. Thereafter, you are required to file a written submissions in response to the notice received. you need to hire an advocate.



Q: Common area usage in Co-Operative Society without members consent

I just wanted to check that In a Co-operative group housing society, can the committee members build anything in the common area without getting a consent from all the members. The common area is divided in 2 bhk and 3 bhk flats and the ratio for payments is also divided in the same parameter, then how can the members take the decision of equal rights for the same common area usage without getting a consent from each and every member of the society.

Committee members are appointed by every flat holders and it is the choice of cooperative society. The elected body can take decisions, however, in case the decision is harmful to any member, it should be considered by the Cooperative group housing society committee. Further, the changes in the common area should be as per the approved plan of the building, the space should not hinder the free movement of the society members and the movement of fire safety etc.



Q: Isn't it necessary to pay the rest 10% GST for commercial property

I have bought commercial property in Gurugram and paid 90% amount. My broker told me, I don't have to pay rest of GST on 10% amount against a law rule. Please help me

The question seems to be incomplete, whether you have paid GST on 90% amount only and not paid on 10% amount only. Or wheterh you had paid 90% of total considerations. and GST is not paid, as the same is not applicable. Please elaborate.



Q: Clarification regarding refund of GST amount when service not availed

I had paid 53100 to a coaching class. Subsequently due to changes in T&C I applied for refund. They refunded 45000. They deducted 8100 as gst amount which cannot be refunded. Are they right in keeping this amount as there is no service so why gst?

Reverse Charge Mechanism may not be applicable on Coaching services, however, it is to understand that on which capacity the coaching organisation has deducted the GST. In my view, it is recoverable on the basis of Credit/debit note. Coaching classess are not applicable under RCM.
