Q: To get the right in property of my Late Husband after my remarried.

Dear sir/madam I'm 23 yo woman from Mathura, i was married with Amit Kumar (Agra) on feb 14, 2014.I have two daughters with him. Unfortunately on 25th January 2017 my husband got expired in a car accident. But i continued living in his house with my two daughters and mother in law. My mother in law had two children including my late husband and one married daughter. After 2 yrs of the death of my husband on 08.03.2019 my mother in law remarried him with a guy of her knowledge (she told to addopt him but she didn't it legally) after my remarried me and my husband along with my two daughters and mother in law lived for two months in my ex husband's house. Now my mother in law throughout me and my husband with my daughters saying that you don't have any right on your ex husband's property. Please help me, what are my legal rights on my ex husband's property.

Q: Builder delayed flat construction by many years

I had booked for a flat on Yamuna expressway in Greater Noida. It was supposed to be delivered in 2015. The builder had mentioned in the contract of buffer period of 2 years.The flat is not yet complete.When contacting builder (last 2-3 years), they say it will be delivered soon, but this promise is not honored. I want to know what remedy do I have available? Is it possible that the builder return my full investment (with / without interest).

I have to file my reply on appeal presented in the tribunal by builder's lawyer so I need help of a lawyer having good knowledge of RERA in writing the replies.

If I want to divorce my wife who is living with her parents for the past 2.5 years and now I don't to live with her, is it necessary to file sec 9 along with divorce?

As per your query your wife is not living with you. It is not necessary to file petition under section 9 of Hindu marriage act first to file any petition for divorce. however it is always advisable for filling section 9 of Hindu marriage for the purpose of making defense in other cases like 498 A IPC and dowery prohibition and domestic violence etc. if you need further information and advice then contact me through the administrator of this website
