Q: Fraudulence by Job Consultancy

For a job opportunity I was asked to pay 2 lakh for a registered HR Services Consultancy with a bond and as they couldn’t provide me any job(Not even a single interview was scheduled) for 4 months so I ask them to stop the process and Initiate for the refund. They said it will take 35 to 45 days to process the refund from the day I said to stop the process. Now they are not returning the amount. how to recover my money back. How to file complaint against Job Consultancy to get back my money??

you can file a criminal case as against the consultancy. before that if you have transferred the money through bank transaction, it will be easy to project your case. if you have paid them by liquid cash, also you can definitely file a cheating case by showing connectivity between you and consultancy like whether you firstly approached them or they approached you, how you heard about them, how many installments that you have paid the entire amount or entire amount was paid in a single transfer etc. if they approached you through online, you can file criminal compliant before cyber crime police or normally you can give compliant ny before District crime branch. once F. I. R registered by police then the offender will be arrested and he will be brought before court of law. and after conclusion of trial if accused found guilty court may order for your money to be recovered from accused by way of fine or attachment from his assets or while pending trail accused willing to return back your money you can amicably compound the case. so first step you need to file a criminal compliant before appropriate police station and you will get remedy

file a return of property under section 451 r/w 457 of crpc in jurisdictional magistrate court of which that your matter is currently dealing with and there is no need for the case to be disposed of . under section 451 crpc says court may order for proper custody of property during pendency of case.
