how to replace damaged share certificate of delhi cooperative society? Thnx.

To replace a damaged share certificate of a Delhi Cooperative Society, the member must submit a written request to the society’s secretary, explaining the nature of the damage and enclosing the damaged original certificate. Along with the application, the member should attach a notarized affidavit declaring that the certificate has been damaged and an indemnity bond on non-judicial stamp paper indemnifying the society against any future claim. Copies of identity proof, address proof, and ownership documents such as the sale deed or allotment letter should also be enclosed.The managing committee will verify the documents, pass a resolution approving issuance of a duplicate certificate, and make an entry in the register of duplicate certificates. A nominal fee may be charged as per the society’s bye-laws. The new certificate is then issued with a note marked “Duplicate” in place of the damaged one.If the society refuses or delays issuing the duplicate, the member can file a written complaint with the Registrar of Cooperative Societies, Delhi, enclosing copies of all relevant documents and correspondence. This process ensures that the member’s ownership rights remain protected and properly recorded in the society’s official records.

In my case my opposite party counsel is demanding documents which i have already filled 2-3 years back and his rights were closed also. It appears that the opposite party is unnecessarily delaying proceedings. Regarding your concern about the judge, you cannot directly request a change merely on grounds of dissatisfaction. However, if you have valid and specific reasons showing bias or unfair conduct, you can move an application for transfer of your case before the District & Sessions Judge (if your case is in a Magistrate court) or before the High Court under Section 407 of the Code of Criminal Procedure (CrPC).You should also request your government lawyer in writing to obtain the case files or apply directly for certified copies from the court record room. If your government lawyer is not assisting, you may request the court to allow you to engage a private counsel or to appoint another legal aid counsel.
