Questions Answered by Advocate Karan Dang
Q: Other party tampering the documents how to check case bundle
Other party and court staff are supporting my spouse in child custody case. How to file petition to verify the case bundle and make sure case documents are not altered. If required how to approach high court for documents verification
Advocate Karan Dang answered
Mere apprehension that the opposite party or court staff may alter the judicial record is generally not sufficient. If you have specific reasons supported by facts, you may file an application before the Family Court seeking inspection of the judicial file and obtain certified copies of all pleadings, orders and documents on record. You may also request the Court to verify the record and ensure that the file is properly maintained. If there is credible material indicating tampering with judicial records, the matter can be brought to the notice of the Presiding Officer by a detailed application. The High Court's supervisory jurisdiction under Article 227 of the Constitution may be invoked only in exceptional cases where there is tangible evidence of irregularity or failure of justice. Therefore, first exhaust the remedy before the trial court and preserve all certified copies for future reference.
Q: Hospital Physician Agreement (Employment Agreement)
Hi, Currently I am working on Employment Agreement of Hospital and as of now I couldn't be able to find the Employment Agreement of Hospital in India. Is there anyone who can help me with this regard? I want an employment agreement of prominent hospital in India.
Advocate Karan Dang answered
Employment agreements of private hospitals are generally confidential and are not available in the public domain. Therefore, you may not be able to obtain the actual employment agreement of a prominent hospital unless it is shared by an employee or disclosed during litigation. However, you can certainly engage an advocate experienced in employment and corporate law to prepare a comprehensive hospital employment agreement tailored to Indian labour laws and the specific requirements of your hospital. If your objective is benchmarking, you may also review publicly available HR policies, service rules and appointment letters of hospitals to understand prevailing industry practices. A customised agreement is preferable to copying another hospital's contract, as it ensures compliance with applicable labour laws, clinical regulations, confidentiality, non-compete/non-solicitation provisions (to the extent enforceable), data protection obligations and other statutory requirements.
Q: request closure of the matter or exemption from personal appearance."
"I am the complainant in eFIR No. 80009641/2026 pending before Saket Court, New Delhi. My stolen mobile phone has been recovered. I have now joined a job in Shillong and cannot attend hearings. I want to know the correct procedure to request closure of the matter or exemption from personal appearance."
Advocate Karan Dang answered
Since your mobile phone has been recovered, the investigation may continue until the police file the appropriate report before the court. As the complainant, you cannot unilaterally seek closure of the criminal case if a cognizable offence has been registered. However, you may inform the Investigating Officer and the Court that your phone has been recovered and that you have no further grievance. If your personal presence is required, you may move an application through an advocate seeking exemption from personal appearance, stating that you are presently employed in Shillong and are unable to attend each hearing. In appropriate cases, the Court may permit representation through counsel and require your presence only when necessary, such as for recording evidence. Engage a local advocate at Saket Courts to represent you and file the necessary applications on your behalf.
Q: Voter ID address shifting out of constituency during Special Intensive
My father submitted Form 8 online five days ago for Name Correction and Mobile Number Registration. We now need to file a second request to shift his address out of the constituency. However, the portal does not allow us to file a new request while the first Form 8 is still pending. Since the Special Intensive Revision (SIR) is starting in 4 days, we are concerned about missing the deadline. Kindly guide us what to do
Advocate Karan Dang answered
Since your father's earlier Form 8 application is still pending, the portal generally does not permit submission of another Form 8 simultaneously. In these circumstances, do not wait until the SIR deadline expires. Immediately approach the Booth Level Officer (BLO), Electoral Registration Officer (ERO) or Assistant Electoral Registration Officer (AERO) of the concerned constituency with a written representation explaining that the first application is pending and requesting either (i) early disposal of the pending Form 8, or (ii) permission to submit the address-shifting request manually/through the ERO during the SIR. Keep a copy of the representation with an acknowledgment as proof that you approached the authorities before the deadline. If the authorities fail to act despite the urgency, you may escalate the matter to the District Election Officer/Chief Electoral Officer of your State through the grievance mechanism. Preserve screenshots of the portal showing that a second application cannot be filed, as they may be useful if any dispute arises regarding the delay.
