Questions Answered by Advocate Kanika Aeri
Q: Cheated By Website Developer - What To Do
I hired a firm to make a website for business use for 10k. After taking first installment they revised the quotations twice by alleging that i keep adding more features, work is more & all this was not explained in detail in starting. Then they took more installments after which they didn't do any work, delayed my site for 1 year under all excuses to frustrate me & then shared the codes of incomplete site with me & asked me to get it made from someone else. No contract was signed but all was recorded in email exchange as proof. Thus they cheated me of 50k. So does the case fall under civil, criminal or consumer court ? What are the charges for each - figting a complete case or just filing a notice from lawyer & court incase I just want to threaten him ? Is my case strong ,worth fighting & how long it would run ? What do you advise ? Thanks
Advocate Kanika Aeri answered
Hi, I have gone through your query and note that you did not enter into a contract with the website developer firm. It’s advisable that you should always enter into a contract before hiring someone for some assignment. Having said that, in order to assess the strength of your case, we’ll have to examine all the correspondences exchanged between you and the firm. As a first step a legal notice can be sent to the firm and after evaluating your case, accordingly a case before consumer forum can be filed.
