Q: Wife seeking maintenance in DV is hiding her bank details

In the declaration of income and assets, my wife has not declared her income and her bank details as she is claiming that she doesn't have a bank accnt. But, she shows up on UPI payment, which is not possible if there is no bank account as it is linked. Can you please tell me what way I can procure her bank details. Also, someone told me to file a RTI to RBI, does RTI provide this type of information?

Advocate Kanika answered
you can approach court or file a RTI for her bank balance or you can file a RTI or you can mention in the court proceeding in front of judge that she has a bank account but she is not mentioning her income so court will direct to the bank produce her bank statement, on the next date of court hearing.

Q: Need advice regarding my Marriage life

In our relationship, there was an incident of adultery, and I took responsibility for my actions. Despite addressing this issue at the Mediation Center in 2021, it seems my wife is still holding onto concerns about our relationship. After three years, she has raised the same issue, first in mediation and now with the Women's Cell. Although I am unsure of her intentions, I remain committed to finding a resolution that preserves our family. I am seeking guidance on the best approach to handle this

Advocate Kanika answered

Q: regarding legal help for almoni of kids after separation

hi i am shweta, i am 36 year old. and currently i am mother of two children. I am living with my husband but wants to separate with him due to lack of understanding and marital issues. currently i am earning only 50K which is not enough to survive in this city with education, How i can challenge my alumni for kids education and life?

Advocate Kanika answered
you can file a case under section 125 of CRPC, for your kids, maintenance from your husband. He can't deny the maintenance of your kids. Also if you want separation from your husband, if it is mutual then the court grants a divorce easily, but if it is a contest then it will take time.
