Hi, i took a personal loan from a bank for 5lakh and from last 2 year i did not make any payment, now they have filed sec138 on me as I gave them 4 blank chqs, i also got summon from court but my family did not accpt those stating that i don't live wth thm coz i got married, what would happen if my family has not accepted those summons, can they put me in jain by issuing warrnt or do I have to go to court on my hearing even my parents don't accept the summon

Dear Client,If summon has been issued against you and you are absconding summons than court will issue bailable warrant against you. In that case police will produce you before the Court. Court may fine on you double of the amount of cheque and you may sentenced upto 2 years or both.

Q: Builder Asking More Money through BBA Addendum

Is there any rule which helps buyers from unwanted Claims of Builder? My builder is asking 8.4 lakhs extra for a flat which was 41 lakhs as per BBA. Almost 20% extra builder is claiming. Project started in 2014 end. Stopped in 2016 end. Now restarting with this new claim. What if I do not sign this new BBA addendum and sit silent with the earlier BBA? Please note that Builder sent me an email intimation only, no formal letter issued to me regarding BBA addendum.

Dear Client,you may file an complaint against the builder in the District Consumer Dispute Redressal Forum against the builder for deficiency in service under section 12 of the Consumer protection act.

Q: Property distribution to one son only

Respected sir, My grandfather was died on 2004 and my grandfather have two son and one daughter.after my grandfather death my grandmother take signature of her sons on the document. i don't know the type of document and register all the property to herself. The property is inheritance property. My grandfather acquired that property from his father. Few month ago my grandmother made 'will' document in this her all property equally divide between sons. But currently she made one more will in which she gave all his property to one son only. Tell me the solution. I hope you are understand and give me the best way out regarding this.

Dear Client,You may challenge the will or the documents on the basis of which he or she succeeded in transferring property in his/her name. You may collect the same from the revenue department or from the office of the Patwari or tehsildar

Q: Builder Default in construction - no hope of possession

Builder defaulted on construction. Builder declared insolvency. No hope of possession. I don’t want to pay home loan EMI. I know this would affect my CIBIL score.Is there any relief?

Dear Client,If the builder default in the possession of the flat, you may file a Complaint against the builder for not fulfilling his promise or for breach of contract in the Haryana Real Estate Regulatory Authority, Gurugram.

Q: Bounced Cheque missing from file

Sir/madam , we had filed a case against cheque bounce (357000/-)and it's been already two years.ow at the final date suddenly the cheque goes missing from the court case file.For information we had changed the advocate in the middle due to unavailability of our first advocate.What to do as Cheque goes missing ?

Dear Client,You may move am application for tracing of the cheque and if cheque is not then strict action is taken against the concerned clerk or he may be dismissed from services for negligence or for stealing the documents from court file. it's a serious crime in the law.
