Questions Answered by Advocate Himanshu Sharma

Q: Divorce decree in Indian court

How can I ensure my Australian divorce is recognized in India before remarrying? I obtained a mutual consent divorce in Australia with my ex-wife’s full participation. We were domiciled in Australia(NRI) and had been separated for over two years. Now I plan to remarry in India. What legal steps should I take to prevent complications and have the divorce recognized in India?

Advocate Himanshu Sharma answered
To obtain a divorce decree recognized in India for a divorce executed abroad, you may proceed by filing a suit for declaration in the Family Court. In this suit, you would request the court to declare that your divorce has already been executed in a foreign jurisdiction and seek its formal recognition in India. The process requires that you present a certified copy of the foreign divorce decree, issued by the court where the divorce was granted. The Family Court will then review the validity of this decree in accordance with Indian laws and judicial standards, assessing it on its legal merits. Additionally, it may be necessary to have the foreign decree apostilled or authenticated by the Indian Embassy or Consulate in the country where the divorce was obtained. This authentication ensures the foreign judgment’s admissibility and compliance with Indian legal requirements for international documents.
