Q: Custody of Indian born Children residing abroad

I filed child custody case in december 2023 for my three minor children residing in Riyadh SA under forcible custody of their father since he abandoned me in 2021.court ordered for the ex parte proceeding on 18th april 2024 as my husband neither appeared nor responded to court summons but the judge who was hearing my case got transferred and the new judge disposed the case on 22nd october saying it is the out of judriction on the basis if sec 9 of guardian and wards act. NOW What can I do?

Hello madam, since it's out of jurisdiction you should file a case of hebas corpus in your concerned high court to produce your children in court. also file contempt of court and file for cancellation of passport.you will be able to get custody of your children.

My friend is in relationship with another woman but due to family pressure married a woman. Now his wife came to know about his relationship. She is filing divorce. My friend always considered his wife as a responsibility and took good care of her. Fulfilled all her needs but never maintained any relationship with her. I want to know what can be helpful points to save him from cheating and huge penalty while seeking divorce.

I am currently going through a mutual consent divorce, with the second hearing approaching. Under pressure, I agreed to pay my wife a large settlement, and I've already paid half of it. However, I was threatened by her relatives into agreeing to this amount, and I now wish to withdraw my consent to the divorce, hoping to reconcile with my wife and remove outside interference.Is it possible to withdraw my consent for the divorce at this stage, especially if I'm abroad and can't travel to India?

in my opinion don't make your life critical by accepting and making u turn. if you are getting threat from anyone you should have informed the court through your advocate. it is advised to discuss with your spouse and short out the matter by mediation.All the very best.
