Q: Summons received by police station but the nor process further

1. For a cheque bounce of Rs 1.5 Lakhs (Sec 138c NI Act) , Summons got finally received by underlying police station. However, respondent is in other district. 2. Police denying to proceed further while lawyer saying find the address of the respondent and go to his place to deliver the summons personally.3. How is feasible for an applicant to carry summons at own and handover to respondent in person ?. It can be threatening if respondent belongs to criminal background. Please advise

1. Summons2. Bailable warrant3. non bailable warrantIn general, The client will try coordinating with the concerned police station first. If it does not work, and the respondent fails to appear, the advocate can ask the court to issue a bailable warrant, and the police station concerned in the district where the respondent resides will be obliged to execute it. However at this stage, the respondent can appear before the court and provide surety and get bail, provided they satisfy the bail conditions. If the respondent still fails to appear post that, the court will issue a non bailable warrant. This gives the police the authority to arrest the accused and bring them directly to the court. Then the trial begins - recording of plea, chief and cross examination, arguments and judgment.
