Q: Wrong case of rape name includes my mom
My mom has been wrongfully convicted in faizabad for false case of rape and more sections she is still in jail since 1 week and we want her to get out on bail because the investigation wasn't at all appropriate and it happened in district court can we please somehow get my mom out she is one of four convicted person main accused is a boy my mom has been sentenced for 5 years.

firstly you can move your mom's bail application before lower court u/s 439 Cr. P. C then session court. if bail will not granted by session court then you can move High Court Allahabad at Lucknow bench.

मेरे पड़ोसी ने हमारे उपर 323 504 506 का मुकदमा दर्ज कराया और अपने से फ़र्ज़ी मेडिकल रिपोर्ट बनाकर जाँच अधिकारी को देकर धारा 308 में चार्जशीट लगवा दिया।जिस अस्पताल के नाम उसने मेडिकल रिपोर्ट बनाया था जब मैंने आरटीआई के तहत सूचना मांगी तो जवाब आया कि हमारे अस्पताल में मेडिकोलीगल होता ही नही है तो इस दशा में क्या मेरे पड़ोसी पर फ़र्ज़ी दस्तावेज बनाने का अपराध बन रहा है? अगर हां तो हम क्या मुकदमा दर्ज करा सकते है

ह बिल्कुल आप crpc की धारा 340 में मुकदमा पंजीकृत करवा सकते हैँ और जिन धाराओं में आपके पडोसी ने मुकदमा पंजीकृत करवाया हैँ उसे भी आप उच्च न्यायालय में क्रिमिनल रिट में चैलेंज कर सकते है इससे आपके ऊपर जिन धाराओं में अपराध बन रहें हैँ वो हाई कोर्ट से खत्म भी हो जायेंगे और कोर्ट संज्ञान भी लें लेगी की आपके ऊपर फर्जी मुकदमा पंजीकृत किया गया हैँ

yeah.. you can get bail.. if you have falsely implicated in this case so you can file criminal writ U/A 226. You can challenge the F. I. R and quash U/A 226.You can get anticipatory bail U/S 438 Cr. P. C before Session Judge. If Session Judge reject the anticipatory bail then you will approach High Court in same section of Cr. P.C
