My self Rajesh doing distributor of reliance comm (Tele comm co) . reliance comm stop his service from 27-10-2017. on this date our retailer and us appox 40 lac rupee balance e-top and paper cupan balance and 45 lac rupee scheme and incentive Pending .so 85 lac is pending. We want to file case against Reliance Communication in the NCLT Court. pl Help what we do

Q: How to recover my pending amount from RCOM
Sir, i am distributed of RCOM last 11 year. He closed his service suddenly date 27/10/2018. Appox 85 lacs is pending amount including demo balance , schme, billing amount.pl give advice how we recover our amount.

Firstly you have to send legal cum demand notice to them and after that if they still don't pay then you can file civil suit for recovery. For filing the recovery suit, appropriate court fee has to be filed alas per the amount of recovery.

It depends upon the quantity of the drug which was recovered. And the previous criminal record of the accused. For better advise do share the copy of F.I.R. as from the contents of the F.I.R. we can only advise.
Q: Status of guarantor in recovery suit
I stood as a guarantor with personal guarantee in 2011 for a business who took term loan from XY bank. Business ran into trouble and promoters requested bank for more time and bank restructure the loan by converting accumulated interest into another term loan in 2014. Bank also took new personal guarantees from promoters and one old guarantor. I refused to give another guarantee and I did not give the new one at all. Now bank has filed for recovery in DRT and have included me also as party for recovery. What is my status in this? What remedy do I have please?

As per the guidelines the guarantor is equally responsible as borrower and it is the wish of the bank for selling which property first. But still you can move yourself to DRT & also to High Court for taking relief to the extent that the property of the borrower be put on auction at first instance.

Firstly make sure you have the seller's affidavit. Then make a police complaint regarding the said fraud against the dealer as well as the seller. Police may lodge FIR under Sections 406, 420 IPC against them.
