Questions Answered by Advocate Dhruva Bhagat

Q: If one name is removed from the FIR then whole FIR is quashed?

I want to know if name of 2 names is mentioned in the FIR and one of them has compromised and if I want to remove one name from the FIR. So my question if one name is removed the whole FIR is quashed or FIR will be there for the other person

Advocate Dhruva Bhagat answered
Proceedings against any accused in a state/FIR case can only be removed/ halted if the FIR against that accused is quashed in High court under section 482 Crpc or is compounded under Section 320 Crpc if the offences are compoundable. If one peson choses any of the above option and get away with the proceedings then the case is still pending against other accused even if he/ she is not named in the FIR. He/she will face the trail in compitent court of law as per law.
