Q: Adoption from brother of a 4 year old child
Hello, As per Juvenile Justice (Care and Protection of Children) Act, 2015 (amended 2021), can a single father of age 58 years age, who has a girl child of 12 years, adopt his brother's son of 4 years. Few details about his brother and sister in law: 1) They got their child from legal surrogacy in India. 2) The child's birth certificate lists his brother and sister in law as legal parents. 3) They don't have any other child. If the parties are Hindu by religion, they will be governed by the provisions of Hindu Maintenance and Adoption Act, 1956 which provides conditions for a valid adoption. In case the parties are not Hindu then adoption procedure as provided in Juvenile Justice Act shall prevail.
