Questions Answered by Advocate Brijesh Singh

Q: Discharge application Dismissed in lower court / legal remedy

Hi - I am just an evidence in an agreement to sell of my father in law who owns property in chandigarh. There has been a fallout of the agreement and the buyer filed an FIR both against my father in law and me under Section 420 due to which a case has been going on in lower court, the lower court has now dismissed the discharge application. What remedy do I have since I am just a witness and no other proof of financial transaction has been found against me ,neither I own any part of the property.

Advocate Brijesh Singh answered
File a Criminal Revision/482 Petition before the Punjab & Haryana High Court challenging the order rejecting your discharge and seeking quashing of proceedings against you.File a Criminal Revision or 482 Petition before the Hon’ble Punjab & Haryana High Court at Chandigarh, highlightingThat you were only a witness; That there is no financial trail or inducement on your part; That continuation of proceedings against you would amount to harassment. If the High Court finds merit, it can quash the FIR and subsequent proceedings against you, while allowing the case to continue against your father-in-law if there is prima facie material.
