Nothing can be said without looking at the averments made in the Complaint and the offenses made out therein. Do post the copies of the private complaint that has been filed against you and the Compromise Decree passed by the MACT so that we would be able to apply our minds on it.
Q: Getting threats from my relatives to press false charges on me
One of my relative (my father's brother) came to my home today (13/4/18) after 4-5 years and has threatened to charge me with murder case of my father when in fact my father went missing 4 years ago. My father had lost his speech and his memory at that time due to some neuro problems. I searched for my father in all places I can but I couldn't find him. This said relative has harassed my husband and me. He tried to physically harm us and also used abusive language to us. I don't know what to do if this person falsely press charges on me. Pls help... He says that he'll complain telling that I and my sick mother killed my dear father. We're not over the emotional distress on acc of my father going missing on top of that my relatives keep harassing us in front of all neighbors using abusive language and telling that we killed our dear father. How can you save me and my family from this harassment. also kindly let me know if I'll have to go through hardship on account of this false charge?
Advocate BK Arun answered
In criminal cases involving facts of this nature, it is not possible to give any opinion/advice without having a detailed conversation. Legal recourse available for a threat of arrest in false cases is to file a Petition for anticipatory bail But how far it is feasible to approach the Court with such a Petition would depend on the facts of the case.
Q: How much time does a case take to conclude
Hi, The lower court ruled in our favour however the other parties have gone for RFA in High court, The case is still pending admission and the case status is "DELAY IS CONDONED" since past 3 years, there is no progress after this,My lawyer says it can take more time, Does it really take time for the case to progress without dates
Advocate BK Arun answered
Yes, what your lawyer is saying is true. There is an acute shortage of judges in the Karnataka High Court and the Court is focusing on the older matters. However, there is a way. You will have to file a detailed application praying for speedy disposal of your appeal. Thereafter, you will have to mention your matter before the High Court and move a Memo praying that your matter be taken up for hearing. Thereafter, the High Court find that there is urgency in your matter, it could dispose it off expeditiously.
Q: Wife is not coming back after marriage parents asking for property
Hi Sir/Madam My Name is S After Getting Divorce from my first wife I saw a poor girl near my house and talked with their parents and fixed my second marriage in a Tempel on 25-2-2018(Just 40 days back) and Tied a Tali to her and AFTER MARRIAGE THEIR PARENTS ARE NOT SENDING HER TO MY HOUSE if I ask they first told we should go to Kula Deiva Temple and then they will send her but they are not Taking us to Temple Nor Sending her to my House and Now they are TELLING YOU SHOULD REGISTER THE MARRIAGE THEN WE WILL SEE. I think she and her parents are trying to take my PROPERTY (I Have a House 3 floors one) SO ONLY SHE IS NOT COMING TO MY HOUSE AFTER MARRIAGE. She has not been with me for 1 minute also. My marriage is not still Registered and I want to know that This marriage is valid without Registration? (I have Tied her Tali in Temple That's all No Homa or any other Rites or Formalities has been done in Temple so this marriage is valid or not) If my Second Marriage is Not Valid then
Advocate BK Arun answered
Marriage need not be register so as to be valid. If it is performed in accordance with the customs of your caste/community, it would be valid. If your caste prescribes saptapadi as a necessary ingredient of marriage and the same is not performed, the marriage cannot be said to be valid. If you want to proceed on the premise that the marriage is valid, you can file a Petition before the Jurisdictional Family Court, seeking for restitution of marital rights. If you don't want to proceed on the premise that the marriage is valid, your course would depend on the remedy you are seeking for. (The remedy you are seeking has not been made clear in your query.)
Q: What to do if Mother in law is mentally torturing me
My mother in law is harassing me by using vulgar words, I'm govt. Employee I have purchased home recently.she is staying with us from last 4 yrs but now she got totally changed. I have taken lots of tension by her taunts, hence I told her to go away from my house. My husband is with me but he can't tell her mother to stay in village house.but she doesn't want to stay away from his son. But I can't take her vulgar language anymore. What to do now, pls help me.
Advocate BK Arun answered
Law cannot change people. It is only the people concerned who can. However, the remedies available to you is a Petition before the Magistrate under the Domestic Violence Act. If you invoke the provisions of this Act, there would be a shadow casted on your husband also.
