Q: Transfer of property after death of the father
I am from West Bengal and I have a brother. My father had died in January 2016. But before that, when we were young my father had attempted to murder upon my mother and then she died in hospital(then the case changed from Attempt t Murder TO Murder Charges) and then we (me and my brother) were legally undertaken by our maternal family.And then we were the witness of the incident against our father. My father had land and house but we have nothing to live in. I want to know if I can take that land in my (our) name or not ? Sr/Ma'm, Please clarify on this. And if Yes, How and what is the procedure ? because here in our village people are asking for lots of money to make "Waaris Certificate" and bringing the Original Documents from the Land Records and then they are saying that they will transfer in our name.Every time they call us they ask for money for no reason. Please help us as we have no one to consult.
