Q: Can a case of adultery be refiled after being withdrawn

Hello sir. Need some help from your side.One of my family friends file a divorce case against his wife.In the family court on the basis of adultery.And he put me there as a third party.And he also file a adultery case in criminal court against his wife and me. But now both of them are going to sign a document in which both of them were agree to live with each other for next two years and give each other another chance.After two years if they found that they can't manage to live with each other. Then any one of them can file a divorce case again.And because of this agreement.The husband is agree to withdraw both the cases.The divorce case and the adultery case in criminal court.So I want to know Sir.That after two years can ipc and Indian law allow that guy again to put a adultery case in criminal court against me. Cause a judge who is my friend told me that if he withdrawal the adultery case this time. Then according to law he never file a adultery case against me in future.I am Hindu

Yes, If he withdraws his complaint based on whatever reasons then he cannot file the same based on same cause of action. But in these two years if again you get involved again then he will also get right to file adultery against you and his wife.



Q: Can I file a defamation case on my co-employees for abusive comments

In 2016 i have given my laptop to one of my colleague to format it.he transfered my all data in to a hard disk and formatted my laptop and gave back to me.but when i asked for my all data to return he said it is deleted automatically.i believed him that time but after somedays i feel like they have gone through my all data and got some private images and videos.they told or showed them to other employees also. Bcoz they use abusive language or comment while talking to me sometimes directly or indirectly.they are defaming my reputation.i dont have any proof what to do?? Please help

You dont need to worry about the proof. This is a matter of cyber crime and therefore information Technology act comes into play. Just register a FIR at your nearest cyber cell. Police will give a call to the accused and investigate the matter further. It is then his duty to show the source from where he received your images and videos.



Q: Precautions to be taken for a fake cheque bounce case

We had issued cheques of Rs 40 lacs to my friend for temporary loan we required for business but he was not responding after that we stopped the cheques but 4 days he presented the cheques .. what should we take steps to proceed , there was no dealing of money nor we given any hundi or any written agreement .. please help , still no legal notice received by us ..
