Q: What action can i take if builder still not given possession

I have booked 3 BHK apartment at Sampada Livia, Greater Noida, Sector CHI V. After 5 years we are till waiting for our flat. We are a group of 15-20 buyers and are thinking to file a case in NCDRC. We have another group of 15-20 buyers who are at a advance stage of filing case against same builder. I have following questions:- 1) If other group files case against builder before we do. Can we also file a different case against builder if we both don't form any association. 2) If first group forms a association and files case first. Can we also file same case with or without forming association. 3) What are advantages and disadvantages of filing case with or without association.

There is no need to form an association to file a group case in NCDRC. The only requirement is that the combined compensation is more than 1 crore. You can file a case even if other group has already filed the case against the same builder.There are as such no advantages or disadvantages of filing a case as an association. The only thing is that one person can sign the petition on behalf of association wherein everyone has to sign the petition if filed as a group but not as association.



Q: How can i take legal action against a restaurant for unhygienic food.

Hello, I want to know that I have swallowed a foreign substance while eating at a resturant, They have provided me with unhygenic food, It was a multinational chain of fast food and I'm really disappointed by their such behavior, Shall I file a demand notice first ? or Shall I file the legal case ? According to FSSAI their liability is of 5 lakh ruppee but i have traumatised by their act and negligence so what would you suggest. Secondly Will a notice sent by me in my personal capacity with my contact details and my college ID card xeroxed on such notice will constitute a proper action or not, As I am also doing law ?

Send them a legal notice for deficiency of services and claim damages. If they do not respond you have to file a consumer complaint with dr district consumer forum. Notice on your letter head will suffice but I recommend you to send them a notice through a lawyer. There is no need to send your ID photocopy.
