Q: bailable warrant pvt. complnt. [sec. 71]

2 days back police came to my home with bailable warrant letter which states that I need to present in acjm court on 29th May at 11 am.I fill the bond that i will appear in the court. My question is that do i need to hire a lawyer for this or I can present myself without a lawyer in acjm court.

Advocate Ayush Arora answered
If the police came to your home with a bailable warrant and gave you a notice to appear in ACJM Court (Additional Chief Judicial Magistrate) on 29th May at 11:00 a.m., here's what you should knowLawyer Not Mandatory, But Strongly RecommendedYou can appear without a lawyer—it’s legally allowed. However, it is strongly advised to hire or take a lawyer with you, especiallyIf the case is criminal in nature. If you’re an accused or respondent in any criminal complaint. If the case involves serious allegations or confusion in legal procedure. Why You Should Consider Hiring a Lawyer:A lawyer can help to fullfill with bail formalities in court. They will ensure your rights are protected. They can represent you effectively in front of the magistrate.Bond needs to be executed, a lawyer ensures it's done properly.

Q: I have issued cheques but due to insufficient funds they were bounced

Court has issued me summons to appear before court for first hearing.I don't have arrangements for surety. Should I appear or not.Pls advice

Advocate Ayush Arora answered
If a cheque issued by you has bounced due to insufficient funds and court has issued summons under section 138 of the N.i act then it is important that you appear in the court on the date mention in the summons.Since this is bailable offence you can apply for the bail on the first date through a local advocate. After that seek time for filing your defenseIf you have bonafide reasons for your defense then provide the evidence regarding your defense to court after appearance
