Questions Answered by Advocate Arun Pratap Singh
Q: Indifferent attitude towards basic human rights of a disabled man
I am a 48 yrs. old disabled (60%), govt. employee. Panchayat had renovated the path 03 times, but either steps were raised or some path was left every time unmaintained towards me. People drain in front of my house and has encroached the path. Since, 2015, I am asking sdm, dc, commissioner(disability) for path and to remove drain, but nothing happened. What options are left for me?
Advocate Arun Pratap Singh answered
First of all you have to produce a representation in writing stating therein all your grievances to the concerning authorities. If they are not doing anything for redressal of your grievances then come to the High court along with the document and copies of correspondence
Q: Can a will be challenged after twelve years of drafting
Can a will be challenged on grounds of fraud even after 12 years to protect my right.
Advocate Arun Pratap Singh answered
This is not clear as to when fraud committed was known to you. If fraud has been committed 12 years ago and it was in your knowledge, you can't challenge the same . But if you knew about the fraud in nowadays you have right to protect your interest and the will can be challenged on the aforementioned grounds.

My land was acquired by Avas Vikas Colony, Uttar Pardesh government 30 years back without informing me and my land was not included in gazette still they acquired and compensation of land not given till now Now After doing case in Allahabad high court on Avas vikas they said take your money which was deposited in government treasury it was not deposited in my account or in court and now they are saying take treasury money according to 32 year old rates. Is this case fit for high court and how much compensation should I expect ?

You have not disclosed about the decision rendered in the earlier writ petition . You have right to get compensation on the rate prevailing at the time when you were informed about the acquisition of the land in question. File a writ petition without wasting time.

You have two options. First , Challenge the FIR before the concerning High court. Second, Go to the lower court and file an application u/s 156(3) CrPC for registration of FIR. If court denies come to the High court.
Q: Owner rented a flat but cheated tenant by staying in shared basis.
3bhk flat with 2 bathrooms was rented at sector 21, noida. Owner asked that he will be holding 1 bedroom and 1 bathroom and will be staying there for just couple of days in a year. As owner used to reside in Himachal. Owner and his wife was residing in the same flat when agreement was done. Later he told that their stay will be extended for a month due to medical issues. We the tenant are family consisting of husband , wife and twin toddlers. We hire a day care maid for taking care of toddlers and household works. The owner later started having issues with my maid and had several arguments with maid which was disturbing us. Lateron the owner literally started commanding us for various household activities. 3 months passed, the owner did not vacate from the flat instead he told that he will be staying for 6 more months. Again had arguments with maid and us for household activities and finally as us to leave the flat for no reason.

This is not clear as to whether there is any agreement of tenancy between you and landlord. if answer is yes you have right to execute the agreement through court . If answer is no then you have to prove your tenancy in the court. Only then you may get remedy.
