Q: Advocate not giving NOC in High Court
I filed one petition in High Court. Till now he filed twice the petition and there are so many office objections. I paid him more than his fee amount nearly 50% extra. I am not satisfied with his service so i requested him for NOC. But he is intentionally harassing me like he is asking to come to collect NOC, after going to his suggested place, he use to wait me more than 3 hrs and not responding my calls and simply saying today not possible
Advocate Aparna Naraparaju answered
1. You have a full right to change your lawyer anytime. 2. Once fees are paid, the advocate must give NOC without delay. 3. Ask him to send NOC by email/WhatsApp or allow pickup. 4. Send a 24-hour written request for NOC. 5. If he refuses, file a memo in High Court and change counsel without NOC. 6. Keep all chats as proof and do not pay him more. 7. If harassment continues, complain to the State Bar Council for misconduct.
Q: Need to understand process and getting conversion certificate
Hi, I'm a Hindu, looking to convert to Islam by getting a conversion certificate from a mosque to get married to my muslim girlfriend. Need to understand the steps and everything else after.
Advocate Aparna Naraparaju answered
1. WITH CONVERSION (Nikah Method)• You visit a mosque and take Shahada (declaration of faith).• The Imam issues a conversion certificate with your details.• After that, you and your girlfriend can do a Nikah before a Qazi with two witnesses.• A Nikah Nama is issued, and later you register the marriage at the Sub-Registrar to get the official Marriage Certificate.• This process is fast and usually completed within a few days.2. WITHOUT CONVERSION (Special Marriage Act – Civil Marriage Method)• You don’t need to change your religion.• Both of you file a 30-day marriage notice at the Sub-Registrar under the Special Marriage Act.• If no objections arise during the 30 days, the Registrar conducts the marriage.• You sign before the Registrar with three witnesses and receive a civil Marriage Certificate.• This option is legally stronger, neutral, and avoids any religious changes.
Q: Invested money for property purchase to sister
Sir I have invested money by cash(not through account) to purchase a land to my sister . The land is now acquired by the government for rehabilitation. And I have received 1st payment of my part through account from my sister. Further the said property is in court for enhancement. But now my sister is claiming it as her property. Now how can I implied to that property please suggest
Advocate Aparna Naraparaju answered
1. Since the land is in your sister’s name, the law treats it as her property. 2. Cash payment by you is hard to prove without documents. 3. Receiving compensation from her account does not prove ownership. 4. Benami law prevents you from claiming the land unless you have strong proof. 5. Your only option is to show evidence that you funded the purchase. 6. If you have proof, file a civil suit claiming your share in the compensation. 7. If you have no proof, your legal claim is very weak.
Q: Cancellation Concern: ₹1 Lakh Booking Amount at Risk
On 24th November, we booked an under-construction apartment and paid ₹1,00,000 as the booking amount, along with a 10% advance cheque (approximately ₹15 lakhs). As per the agreement, it was mentioned that if the buyer cancels after paying the 10% advance, the builder would deduct 10% of the advance amount as cancellation charges. On 28th November, the builder returned our advance cheque because the linked bank account did not have sufficient funds. We were planning to issue a new cheque. Howeve
Advocate Aparna Naraparaju answered
1. The 10% advance cheque was never cleared. 2. So legally, you never paid the 10% advance. 3. The cancellation clause (10% deduction) applies only after actual advance payment, not before. 4. You have paid only ₹1,00,000 booking amount. 5. Builder cannot deduct anything from 15 lakhs because it was never paid. 6. Ask builder to refund the ₹1 lakh. 7. If they refuse, send legal notice and file RERA complaint.
