In such a scenario, you can file a case of cheating and fraud against the agency. You’ll have to show that you defrauded by the company. You’ll have to proceed by lodging a FIR against the placement agency. Kindly provide me more details to assist you better.

Q: Obtain succession certificate And Get NOC from Legal heirs staying out

I want to obtain succession certificateAnd Get NOC from Legal heirs staying out of the country. In the following post the transfer of property has been mentioned https://lawrato.com/property-legal-advice/how-is-the-property-distributed-after-death-of-husband-21511 It says that in case of no will, the property is transferred to widow and children. One of my son is studying abroad. Please tell us on what steps he need to take in order to send us no objection certificate.

Advocate Ankit Sharma answered
It’s correct in case of an ancestral property/self acquired property, if the deceased died intestate then the property devolves upon widow and children in equal shares. In order for you to acquire the property, you will have to either get a relinquishment deed in your favour from your sign or a partition/ family settlement deed registered in your favour. Kindly provide me more details to assist you better.

Q: Regarding sharing fake news on website

Sir. I am arrested for forgery for sharing fake news on my website. Bt i received that news from whatsapp group and I don't know that news was fake . How to defend myself in court. I already get bail from police station.

Advocate Ankit Sharma answered
As per your information , the offence of forgery is not made out. Forgery as defined in IPC has different elements. You should move against the FIR in HC and get it quashed in case the FIR doesn’t contain the correct facts. Kindly provide me further details to assist you better

Q: Property dispute on common wall with neighbour

We have purchased a buildup property in 2005 with common wall 4.5 inch each with east side property(common wall is 9 inch) .On GPA paper its written 15 x 35 area, but in actual its width is more than 15.9 inch including 4.5 of common wall. Now when we are doing construction after demolish 4.5 inch of common wall and we have done the construction till ground floor, then our neighbours saying that he has 3 inch in my area. Actually our common wall is not straight, so in last portion of my property he is saying about 3 inch. As common wall is not straight thats why he is claiming for 3 or 2 inch at different positions. He is fighting with us and my labours and not allow to do more construction. He breaks my constructed wall as well on first floor.Kindly guid me what to do?

Advocate Ankit Sharma answered
If you have purchased the property as per law and are the legal owner then you can file a suit for injunction/ stay against the Neighbhour. He cannot obstruct you from constructing your property. Kindly provide me more information to assist you better

Q: Ancestral property gifted to 2 child and not third(me daughter)

I am the youngest sister(marrired) of my elder brother and sister. My father gifted his entire house to the elder sister and elder brother and not an inch to me.The property was obtained from my grandfather and my father succeeded as a heir to the property.I was not even not informed when the property was divided.can anything be done to take my share?Recently I have heard about Supreme court decision on something like this "Daughter claim to father property" whats that

Advocate Ankit Sharma answered
Yes you have a strong claim in your favour. As it was an ancestral property, you have an equal share in the property as that of your siblings. Moreover, your father does not have the authority to make a gift deed of the entire property as it is a coparcenary property. Kindly post me more details to assist you better
