Q: Car buyer blocked cheque claiming fault after testing before purchase

Hey i have sold my car to someone in 115000 and he gave me 35000 by cash and 70k cheque and next day he called me and said car engine is not good. So i will hold your cheque. He checked car properly and took 4-5 hours to take a decision. So how can i get back my money?

Advocate Ankit Kansal answered
if you want to get your money back then you have to file one civil suit for recovery of 35k and one cheque bounce case for 70k.. first deposit that cheque with your bank for encashment.. Buyer has definitely cancelled the cheque and in that situation cheque will return back with return memo with the reasons. now as per law you can file a cheque bounce complaint on him (buyer)
