Q: Wife affirs another men So husband want divorce his wife

in which - which sec present application before court due to criminal and family court

Advocate Ananth Shankar Sharma answered
Either party to the marriage may present a petition for divorce under cl. (i) of sub-sec. (1) of s. 13, on the ground of adultery of the respondent. In case of adultery direct proof is difficult to get and one has to rely for proof thereof on circumstantial evidence and the same may be sufficiently proved from which adultery maybe inferred. The burden of proving adultery in a matrimonial case is on the person who makes the allegation

Q: Parents torturing mentally and physically for marriage she wont say y

I'm 21. My gf is 26. We both share same "Gotra" which is an issue for our parents. Im a dropout (because of COVID) and she has done [B.Com] and [M.Com] .I'm looking for a job and her parents won't let her do any job. She was waiting for me to get a job I asked for 1.5 to 2 years time. Both of us are serious and want to marry in future. Her parents knows about us so they forcing he to marry someone else, she said no and refused so now they torturing her mentally and physically. Cant file any complaint because that will create more problems for her. Our parents are not ready to listen. her parents straight up torturing her mentally and physically to say Yes for the forced marriage. My dad says I will prefer samaaj (Society) over you or your happiness. I am actually considering running away but again, Job is the issue. Now if we run away her parents are going to hold onto her documents (all of them).Any way we can get those back on our own without parents knowing ? What should we do?
