Advocate Akram Imtiaz Ali answered
yes a case can be filed against the school authorities. file a money suit against the school authorities and the broker and claim back the money along with interest. if you have money receipt and transaction details in the account of school you can show the details to claim the money

Q: Alimony and maintainance issue

I am 59 years now, I got married 1989. My husband decided not to give any many. He is 64.I am Hindu.

Advocate Akram Imtiaz Ali answered
do you have any children? If you want divorce then you have to file a divorce petition and also claim maintenance for yourself and your children. your husband will be ordered by the Court to give money to you to maintain yourself and your children if they want to stay with you.

Q: Inheritance

I am a female step-child of a father who died intestate. Or, rather, he left a hand-written will (unregistered) with two witnesses leaving his estate to me. Do I have any claims to the property or bank-accounts?

Advocate Akram Imtiaz Ali answered
Yes, you are eligible. Since I don't know your name I am not able to make out under which personal law you will fall. As per your religion and personal law the share of property you will receive will be determined.

Q: Is mutation of land necessary for land

My father had purchased a land of 3 katas out of 6 katas from my Uncle and done regisyration of the land. Now my father and uncle both are nomore and some other person taken the possession of my uncles land by giving some money to my aunty. Now the person is trying to sell the land and I fear that the person might include my land also for selling as my father had not done any mutation of the land. Please suggest me what I should do now by understsnding the above said situation.Thanking you.

Advocate Akram Imtiaz Ali answered
Sensing your problem I suggest you should mutate the land first in the name of your late father's name and thereafter in your name by means of inheritance. once you mutate and obtain the draft chitha, jamabandi and trace map of the land you can easily demarcate your land and hold it in your possession. And sale thereafter without your permission will be illegal. moreover the Sale deed of your father is the most vital document for your proof of ownership.

Q: How to make a deed for sharing rooms/floors of a house.

Sir, We have a 2 storied house on a plot measuring 1.5 katha constructed by my father. The ground floor is occupied by my brother while I stay in the first floor which is tin roofed. Recently, I have extended the house and constructed 2 new floors adjoining to the existing building taking homeloan which is paid by me only. Again I give the ground floor of this new part to my brother and take the first floor but without any agreement. I also expressed my brother that since I had spent a huge amount for the new floors, the space above the floors will be in my control and I can only build house there in future and my brother have no control over this area which is also agreed by my father too. Now, my question is since we did not make any agreement, will there be any problem in future. I want to make an agreement for the property. Please advice how to go about it.

Advocate Akram Imtiaz Ali answered
You can make a mutual partition agreement between yourself and get it registered. In future you can get the property partitioned and mutated in terms with the said registered deed. in the said deed make sure you mention the entire details of the property.
