Q: Take legal action against an agent in RTO

I went to my nearest RTO to clear the LL test. I could not be aware of an agent in RTO. An agent asked me for the reason for coming. Then I said information about my LL test slot. Then he takes my document and fill a form and take my signature and charge 4700 rupees for LL. I was surprised and at that time I had not enough cash to pay the amount but I pay online to a shop and the shop arranged money to pay the amount. But after a month I realised that the agent cheated on me because of no response in communication how to get refund from the agent?

if he has not done the work for which he taken money from you then it can be considered that he has cheated you. If he has cheated you you can file compliant or fir againts him under section 420IPC and also you may file money recovery suit for recovery the money but before filing fir or recovery suit you may send a legal notice to the agent due to which the againt may return your money willfully.

Q: Regarding IPC 376 Under Barrackpore Sub Divisional Court

Car parking issue & Unsocial activities in her house. She made an complainant and after investigation, police filed chargesheet under section 376. Now the police arrested the accused after 4 months from the day complainant lodged. She refused for medical test in respect of ipc 376. No witness is there. All know the incident occured owing to car parking issue. Please explain what wiil happen as an outcome from trial at the end from your experience

Nothing will happen to the accused if the case is lodged with false ground as there will be no evidence againts the accused. The accused of thie case will be acquited at the end of trial. In such situation the complaint will not be able to show any valid evidence before the court of law. Thus the accused will be acquited easily.

Q: How to Withdraw a FIR case, registered in kolkata circle.

Fir filled by my sister on August 2021 against her husband, father's in law and her three sister in law. Husband arrested in the month of June 2022, IO take PC for 10 days. After 10 days he got a bail. Four other members not get the bail. The husband apologized to my sister at the police station that now such a mistake will not happen again. nSo we want to withdraw a case and we do not want to continue this case- Advise me how to withdraw a FIR in police station.

If the the case is registered with compoundable section it can be withdrawn by you. but if the section under which fir is registered are non compoundable. then it can be withdrawn by you. Hovewer the case can be dismissed easily as the parties are co-operating with each other.
