Dear Sir,

There is no time limit for filing of probate. Probate can be filed under Section 222 or 276 of the Indian Succession Act, 1925 in the Testamentary Jurisdiction of the High Court where the person has deceased.

As per the limitation act, an application for probate of will is required to be made within a period of 3 years from the date of death of the testator. If an application is made after the said limitation period, request for condonation of delay has to be sought from the court with proper reasons for delay in making the application. It is then at the discretion of the court to decide whether the delay can be condoned and the application admitted.
