School address a money deposit scheme but there fail to continue.

A education institute has taken 2 lakhs deposit through promissory note and they told that they will give free education till 10th class using interest of 2 lakhs and they will provide 2 lakhs back after completion of 10th class or also they have promised to give back the amount if we discontinue scheme. but he was not able to do whatever he promised to do with us and the capital of 2 lakhs also is not looking like he can give us back. because now he was jailed and CBI enquiry is going on. So what to do now get back my money.

first you have any document regarding that you have paid 2 lacs to the education after that they give any hand writing letter or anything which you can prove they had said this to you, thereafter you money you will definitely get you money with interest. if you able to prove what you have said in the question and one more issue create if your able to do you can complaint a police station near by you.

File a suit for recovery in the district court in the jurisdiction of which the educational institution is located. Make the educational institution as defendant no.1 and person in jail as defendant no.2. Don't worry about service of notice on this person who is in jail as the same would be governed by Order 5, Rule 24 of the Civil Procedure Code, 1908. It is easily done by effecting service on the officer in charge. Once your obtain a decree in your favour from the court then this person's property can easily be attached whether he is still in jail or not. Remember that CBI investigation and your recovery are completely separate proceedings - one is criminal and the other is civil. So no need to worry, approach the Court immediately before your claim gets barred by limitation.
