Driver refusing to payback the advance taken - how to recover

Sir, My driver has taken an advance of Rs 10000, stopped coming to work after taking the last salary. How can i recover the money through the legal system?

Depends what way was the loan advanced to him by your goodself. If you have any receiving from him it would be better otherwise your case is slightly weak on that footing. But the amoun can still be recovered.

Dear Sir,
You may file a suit for recovery of money under Order 37 Rules 1&2 of the Code of Civil Procedure 1908. You may filethe suit either in person or through a lawyer. However I would advise you to consult a lawyer before filing the suit.

It is advisable in the first place that you get a legal notice issued to him for recovering the amount.
If the legal notice is not responded then the option have to file a recovery suit against the driver.
I hope that you have receipt for the advance given to the driver.
