I am planning to buy an old home. 1) The property owner has expired. His wife is alive and has 3 sons and 1 daughter. The grandson (Daughter's son is handling the sale process) . Out of 3 sons 1 son has expired. All are married and have children. Who all will be the legal heirs and should be signing the property documents at the time of registration ? 2) The property documents do not have any information about the old home. Will there be another document for the home constructed. 3) Also i need to check if the Home has Municipal permission. How do i get that ? Currently the seller(Grandson) doesn't know about it. 4) The property is registered in 1981. Should i request for all the linked documents before 1981 ? 5) Should i post a paper advertisement before buying property ? And if so what should be the content. 6) Lastly what are mandatory documents which i should ask so that i dont fall into trouble after purchasing the property ?

The legal heirs of the property owner will be
a) His wife .
b) Living sons
c) living daughters and
d) Children of pre-deceased Son. (if the children of pre-deceased's son's are minor's then court orders are necessary.
Since the house is a old property, you will have to ask for
a) Property tax records of the house.
b) Link documents before 1981 will be helpful
c) Posting advertisement before buying property is a good step. the contents varies depending on nature of property and nature of claimants. A lawyer who is doing title deed verification can offer help in drafting the content.
d) Mandatory documents
a) title deed of the property owner in original
b) Death certificate of Property owner
c) Property tax receipts of the old house(last 10 years)
d) Legal heir certificate of property owner
e) Death certificate of Pre-deceased's son
f) Legal heir certificate of Pre-deceased's don
g) If any of the pre-deceased's son is a minor, then court orders permitting the sale.
