Possession letter received without completion or occupancy certificate
01-Apr-2023 (In Property Law)
I am looking for some solution in a property issue where the builder has given us a offer of possession without having completion certificate. We refused to take the possession without completion/occupancy certificate. Since then the builder has stopped responding to my calls and email. Please guide the best way out. Is there any way to go to consumer court or legal notice or anything else. Request you to suggest the detailed way to get out of this problem without paying any interest on delay in payment after getting offer of possession. Till then, I have paid all instalments on time
Firstly file an RTI inquiring that whether the builder has applied for completion/occupancy certificate and further inquire that if the builder has applied then what is the status.
Keep your RTI application precise as you are running short on time.
On receiving the reply of the RTI application send them a notice.
Kindly record all your conversation with the Builder in form of e-mails. Write them that you had called them and no reply sought.
Please feel free to contact the undersigned for assistance.
