16-Oct-2023 (In Property Law)
Dear Sir, My Dad's Ancestral Property is gifted in 4 parts to me,my brother, my mom & dad. Now according to law 2005 the daughter should get equal share. Now my parents and brother are secretly trying to sell the property. Can I go to law and issue a Permanent Injunction Suit and demand equal share in Ancestral Property. Please advice ? Thanking you.

The Supreme Court Judgement is pertaining to ancesteral property.

If your father had self acquired property and since ince your father died intestate and if it was his self acquired property then as per section 10 of Hindu Succession Act, the property will devolve to all his legal heir including daugthers.

The daugthers/ sons can file suit for partition thereby seeking their share in the property.
