How to report against invasion of privacy

Hi , We are aboding in 3rd floor on rent and the persons who are living in srcond floor have rooted in the cctvs on the common passage in such a way that our visitors too are getting monitored, with which we are not at all comfortable as i conduct language classes n my students are also feeling uncomfortable so can we object on the same

Hi,
Yes, you can object for same on the grounds of that every citizen has Right to Privacy and such act of installing cameras in common passage amounts to intervention with one's fundamental rights. Also, it is a kind of Public Nuisance for which criminal action can be taken under Section 268 of the Indian Penal Code, 1860.

Yes you can file a complaint or you can file a suit for mandatory and permanent injunction against those persons who have installed CCTV in a common passage again I would like to add you can file a writ in high court under article 226 if you want quick result

Is the person who is living on 2nd floor is the owner of the flat. If yes it is his priority right to have a security over unwarranted strangers. You don't have any legal right to take an action against him, however you can install infrared blockers.
