Job now after retirement he has left the house n started staying with another lady. I want to know what rights I have on his property. I doubt he can sell off the house we stay in. Being a legally wedded wife you have right on your husband's property and your children are also entitled to get share in their father's property. You can file a civil suit before civil court having jurisdiction over the property for restraining your husband from selling the property.

Madam,
you have all the rights against your husband, you can claim maintenance, You can get injunction against the selling of the house you are living in. Other wise you can claim legal right of residence under domestic violence Act if lose the house and claim maintenance. You can also file petition for Restitution of conjugal rights under Hindu Marriage Act which means to force the husband to keep you and children with him by the order of the court. You can also get order from the court under section 125 Cr.P.C for maintenance to be paid out of the pension which will be paid to you directly.
