How can i get parents property transferred in my name.

Sir/ Mam We are a 2 brothers and both are above 25yrs of age. Our parents are died in natural way a year back and now we want to transfer our parents residential property which is in Mumbai to our names. This property is under redevelopment plan from private builder and may go for construction in next few years. My query is that " can this developer transfer this property on our both names" or it just get transfer to one of our name by Transfer Deed or shall we require one NOC to transfer this to only one person name. As I am the elder son our Electricity Bill and other bills are on my name. Could you please help here.

firstly need to understand whether your property is a freehold or tenanted. in case of a freehold property you need to get transferred in both the sons name by complying all the procedure. whether your parents left any will??? also need to know you both are the only legal heirs of your parents??

You would have to file heirship application before civil court. If you both want share in property as a joint owner then both of you will have to make application or else get noobjection certificate from your brother by paying him his share amount. For further info contact me

No developer will not transfer that property in your name. You can do release deed, gift deed in your name . Before that you need to take letter of authority from the court of law to take absolute right.
