Fake case by my mother that I am forcing her to transfer property

21-Feb-2023 (In Property Law)

Father's ancestor's property is on my mother's name. Also property my father purchased is also in my mother name. Mother never earned money.Mother and father both signed/registered Gift deed to me one year back. We have 2 more other witnesses signed on this). Now parents live in the same home . Father handicapped. Now , Mother under sister's influence want to file case that I used force to get that gift deed. I am USA citizen. How can I handle this situation ? How harmful ? Father is on my side. Can he say there is NO force in registering? Do we need both signs for gift deed revoke ?

Once a gift deed is registered, then without the permission of donee(you) nobody can take it back.
Your mother may say that you had forced her to Gift her property, but it needs to be proven. I recollect you asking this question in another portal and i answered it . Nothing wrong about it. But you are now saying both the parents live in the same house. That is a source of worry as she might claim that she was unaware of the gift deed and you had made her sign it. the fact that she is living in the gift property legally may be construed as you not taking possession of property. to avoid this get a registered lease deed signed by your father for safety purpose.
Also in the recent past, we are seeing cases where senior citizens are claiming that the children are not looking after them and hence the gift by them to the children needs to be revoked unilaterally and as per law it is valid.
The best option would be to get the lease deed done by your father and also take good care of them by providing medical and other support. any financial transactions with your parents, please do it through bank so that it stands as evidence.
