Builder has deposited cheque without the buyer's knowledge

Dear sir, I have selected a 3.5 BHK flat in Tasken real estate project , Kolte Patil Developers in Kharadi, Pune. For better negotiation, sales representative had asked me to issue cheque of Rs 500000/- so that he can show to the management and negotiate on pricing. Now builder have deposited cheque without my permission. He didn't give me any acknowledgement receipt for the same. Can I take any legal action against builder ?
Write a letter and ask them to issue a receipt or acknowledgement within 7 days of receipt of letter.
If they do not issue receipt file criminal complaint before police authorities against the sales representative as well as against the builder u/s 420, 409 r/w. 34 of IPC and also attach your bank accounts entry of withdrawal of cheque amount of Rs. 500000/-

Are you still interested in purchasing this flat , if yes then ask the builder to issue allotment letter to you
If no then send him a legal notice claiming for refund and blaming him for illegally depositing cheque without issuing allotment for the flat.
