Brother want to sell joint property how to get our share

Mere husband last 9 years se apne brother se apna property share( 50 %) ke liye baat kar rahe the but he didn't give our share. But now he send decree for demolish partnership. Not given a penny. What to do?? My husband is ready to do so but he only give us post dated cheques. Is this safe to sign decree pls suggest me .

The facts are not very clearly stated. I good look at the documents would be required to be able to guide you properly in the matter. However, if he is asking you for entering into an agreement with him whereby he buys you share or he sells the entire property and gives you 50% of the proceeds you could do so. Receiving post dated cheques is not an issue as you could always approach the Courts in case the cheques bounce. Make sure whatever you do you have the agreement reduced into writing with clear terms. Consult a lawyer if need be.

never ever sign any property on post dated cheque.

Buying or selling property on CHEQUE is VERY VERY RISKY BUSINESS.

you cannot get the sale cancelled, if cheque bounces,

you can only file criminal case of cheque bounce and in civil court the plea of cancellation or decree or property sale deed is not maintainable even if the cheque is dishonoured.

So never ever do that please, you will loose the property and not even get the single penny.
