A group of people harassing and threatning my aunts

25-Jul-2023 (In Property Law)
A group of member and police officers are compelling to provide a piece of land for drainage from our own land to an individual. They tresspass into the land and threaten my relations. Only my aunts (two ladies) with a Differently disabled kid is living in the house, are regularly abused and threatened with sickle and other materials. This causes a heavy mental torture to the differently disabled kid and life threatening to my aunts. Kindly suggest the Sections i can apply for legal proceedings.

First of all you may advise your aunts to contact a local advocate and brief him/her about the problems they are facing from the people who you have mentioned.
The advocate will issue a legal notice instructing the concerned people to refrain from indulging into such illegal and unlawful activities.
If they dont listen or not stopping their such undesirable activities then you may first approach civil court with a mandatory injunction suit seeking court direction restraining the concerned people from interfering into her peaceful possession and enjoyment of the property in any manner.
Besides this, your aunt may prefer a complaint before the human rights commission against the erring people seeking immediate relief and remedy.
You dont bother about the section for the legal proceedings, your lawyer will take care of all those legal aspects.

You have a specific relief of restraining any other person from disturbing the peaceful possession and enjoyment of your property. For getting this the property should be your own property. You should get an interim stay form the court which is more practical and achievable right on the first hearing in your case under Order 39 rule 1 and 2 of CPC read with specific relief act.
The police official can only comply with the order given by the court and can not act against it. Thereby your right over the property is fully secured.
