Employer not allowing to apply for Maternity leave

24-Dec-2023 (In Labour & Service Law)
I work for a PSU bank for almost 2 years where maternity leave is for 6 months. In May 2016 I was transferred to a location away from Kolkata. My pregnancy got detected in July2016 and I had to be on rest for my entire period of pregnancy. Hence I was in loss of pay from August 2016. Each and every month I have submitted my medical certificate certifying my current health condition to my employer without fail. Now when I am applying for maternity leave from Jan 2017 (I am due in Mar 2017) they are not allowing me to apply stating a reason that LOP cannot be combined with maternity.I have again submitted a fresh set of documents clearly mentioning my inability to travel. I have even offered to let me report temprarily to the nearest branch so that apply for the leave. But my HR is persisting that I join the base branch some 300 KMs away in this health condition. Am I not eligible for maternity leave even if my LOP is due to pregnancy related issues. What legal options do I have?
