18-Mar-2023 (In Labour & Service Law)
Dear Team, I am from Karad, Maharashtra. I have salary below 21000 and as per the latest rule I am covered under ESIC. But I am having queries related to employer contribution as our employer deducting ESIC employer Contribution(4.75%) from my CTC. I just want to know is this ok or they should increase our CTC amount of Employer contribution. Please suggest as my 835/- Rs of employer contribution is deducting from my salary and they are saying its as per the government rule. Please help.

Employee State Insurance Corporation(ESIC) is deducted on gross salary which is 1.75% from the employee contribution & 4.75% from the employer contribution. The employer can not deduct the employer contribution from employee's CTC as it is against the law, you can ask your employer to do the same with providing the documents and rules supporting your claim. Also, if the employer denies then, you can file a complaint against him in the work committee, then labor court, then, national tribunal if the issue is still not resolved.
