One of my friend of Hindu Family lost her Husband recently 4 months back and having a son of 4 years . Her Husband was working as teacher in ZP school of Maharashtra State Govt. She has got govt job 2 months back. She is entitled for the pension from her deceased Husband's job, but Her Mother in Law and Father in Law are claiming share in that pension ( i.e. 1 Pension to be divided in 4 shares 1 to wife ,1 to Son , 1 to Mother in law and 1 to Father in law) Her Brother in law is alive and earning and parent in laws are living with him.Can there demand of share in pension be legally denied ?

Parents have right to maintenance by their children. In case of pension, the first right to it is of the wife and the children. Parents cannot claim pension of their dead son. Parents can claim maintenance from their living son.
